Acceptance

By using bracketproof.com (the “Site”) or purchasing a Tournament Pass, you agree to these terms. If you don’t agree, don’t use the Site.

What BracketProof is

BracketProof is a data-driven NCAA men’s basketball tournament bracket prediction tool. We use publicly available college basketball statistics (primarily KenPom efficiency data) plus our proprietary models to generate predictions.

BracketProof is nota gambling or sports betting service. We don’t take wagers, don’t operate pools, and don’t facilitate any form of wagering. If you choose to enter a bracket pool, you are responsible for compliance with applicable gambling laws in your jurisdiction.

The Tournament Pass

The Tournament Pass is a one-time purchase granting access to BracketProof’s prediction for a single NCAA Men’s tournament year (the “Covered Year”). For 2027, the price is $14.99 USD. Pricing for subsequent years is posted on the Site.

You will receive your bracket after Selection Sunday for the Covered Year, with delivery targeted for the Monday of tournament week. The pass covers a single tournament season and does not renew automatically.

Predictions are not guarantees

Our predictions are based on statistical models applied to historical data. They are not guarantees of future outcomes. College basketball outcomes are inherently uncertain. We make no warranty, express or implied, that following our bracket will result in winning your pool, placing, or avoiding losses. You assume all risk of using the predictions.

No refunds

All sales are final. Once your bracket has been generated and delivered, the work is done and no refunds are issued. If something goes wrong on our end — the bracket never arrives, the model fails to generate, anything unusual — email support@bracketproof.com and we’ll make it right. Small operation on this end; a real human reads every message.

Your account

You may create an account using email/password or Google OAuth. You are responsible for keeping your credentials secure and for all activity under your account. Accounts are for individual use only. We reserve the right to suspend or terminate accounts that violate these terms.

Acceptable use

You agree not to:

• Scrape, bulk-download, or republish our predictions, models, or written content.
• Use automated tools (bots, scripts, crawlers) to interact with paid areas of the Site.
• Attempt to bypass the paywall, impersonate others, or exploit security vulnerabilities.
• Use the Site for any illegal purpose.

Intellectual property

Our predictions, models, written content, and designs are owned by BracketProof. You may use predictions you purchased to fill out brackets for your personal pools. You may not republish, resell, or redistribute our content.

KenPom efficiency data is sourced from kenpom.com and is the property of its creator. We use it under our own subscription and do not grant you sublicense rights to that data.

Limitation of liability

To the maximum extent permitted by law, BracketProof is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Site, including but not limited to lost pool entry fees, missed picks, or other financial losses. Our total liability to you is limited to the amount you paid for your most recent Tournament Pass.

Disclaimers

The Site is provided “as is” and “as available.” We make no warranties, express or implied, about availability, accuracy, or uninterrupted operation.

Modifications

We may update these terms over time. Material changes will be posted to this page with an updated “Last updated” date. Continued use of the Site after changes are posted constitutes acceptance of the new terms.

Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any disputes arising from these terms or your use of the Site will be resolved in the state or federal courts of competent jurisdiction located in the State of Georgia, and you consent to the personal jurisdiction of those courts.
